IMMIGRATION LEGAL SERVICE
Standard motion to reopen or reconsider before an Immigration Judge or BIA
For a person seeking one motion to reopen or reconsider a decision by an Immigration Judge or the BIA. The remedy, supporting record and filing requirements depend on the tribunal and grounds.

STARTING YOUR CASE
What this service involves
We begin by reviewing your immigration history, eligibility, documents and goals. This helps us determine whether the standard service described here fits your situation and what evidence will be needed.
PREPARING YOUR RECORD
Typical documents we review
The exact documents depend on your history, eligibility and the filing requirements.
- Underlying court or Board decision
- Available original filings and supporting evidence
- Facts or legal issues supporting the proposed motion
LEGAL PREPARATION
How we prepare the case
We assess jurisdiction and timeliness, develop the motion grounds, prepare one brief and ordinary exhibits, and file with the correct tribunal.
We explain the filing plan and any case-specific concerns before the representation begins.
FLAT-FEE SCOPE AND LIMITATIONS
What is included and what costs extra
Flat attorney fee for one standard motion to reopen or reconsider before an Immigration Judge (IJ) or the Board of Immigration Appeals (BIA), covering one motion before one tribunal. Includes review of the underlying decision and available record; assessment of filing deadline, jurisdiction, and grounds for the motion; legal research; preparation of the motion and supporting legal brief; ordinary supporting declarations and exhibits where applicable; filing through ECAS when authorized and available; required service; and routine case tracking. Excludes government filing fees; transcript costs and extensive records retrieval; translations; expert evaluations or reports; emergency stay-of-removal requests; complex ineffective-assistance-of-counsel or changed-country-conditions matters; new applications for relief; additional motions; appeals; federal litigation; and representation after reopening. Complex or unusual proceedings require a separately defined engagement. USCIS Form I-290B appeals and motions are a different service, priced separately. Where applicable, responses to Requests for Evidence (RFEs) relating to the covered matter are included in the flat attorney fee. Any USCIS Notice of Intent to Deny (NOID) response arising from this covered application or representation, like a related Request for Evidence (RFE) response, is included in the stated flat attorney fee at no additional attorney charge.
The signed representation agreement controls the exact scope. Government fees and outside costs, where applicable, are not included unless expressly stated.
COMMON QUESTIONS
Before we begin
Are government filing fees included in the price?
No. The displayed amount is the attorney fee. USCIS, consular, medical, translation and other third-party charges, when applicable, are separate unless the specific scope expressly says otherwise.
Will you charge an extra attorney fee if USCIS sends an RFE or NOID?
No additional attorney fee is charged for RFE or NOID responses arising within a Green Chavez matter already covered by a flat-fee representation agreement. The separately priced RFE and NOID services are only for new clients with applications filed independently or by another firm.
How do I find out whether my case fits this standard fee?
Contact our office for a case-specific eligibility and scope review. If your situation falls outside the listed service, we will explain the additional work and fees in writing before you hire us.
