Immediate Relatives

Immediate relatives of U.S. citizens include spouses, unmarried children under 21, and parents of U.S. citizens who are 21 or older. This category is not subject to annual numerical limits, meaning visas are always available. The process involves filing Form I-130, attending an interview, and undergoing a medical examination.

Spouses of U.S. Citizens
 

  • Eligibility: Must be legally married to a U.S. citizen.
     

  • Process: File Form I-130, attend an interview, and undergo a medical examination.
     

Unmarried Children Under 21 of U.S. Citizens
 

  • Eligibility: Biological, stepchildren (if the marriage creating the step-relationship occurred before the child’s 18th birthday), or adopted children.
     

  • Process: File Form I-130, followed by consular processing or adjustment of status if the child is in the U.S.
     

Parents of U.S. Citizens
 

  • Eligibility: U.S. citizen must be 21 or older.
     

  • Process: File Form I-130, followed by consular processing or adjustment of status if the parent is in the U.S.
