Family Based Green Cards
Family-based green cards allow U.S. citizens and lawful permanent residents to sponsor certain family members to live and work permanently in the United States. At the Green Chavez Law Firm, we are committed to helping families reunite and stay together through this complex process.
Eligibility Requirements
There are two main categories for family-based green cards:
Spouses, unmarried children under 21, and parents of U.S. citizens.
Includes adult children, married children, and siblings of U.S. citizens, as well as spouses and unmarried children of lawful permanent residents.
Application Process

-
Petition Filing: The U.S. citizen or permanent resident sponsor must file Form I-130, Petition for Alien Relative, to establish the qualifying relationship.
-
Approval and Waiting Period: Once approved, the petition is sent to the National Visa Center (NVC) for further processing. Immediate relatives do not have to wait for a visa number, while family preference categories may have longer wait times due to annual visa limits.
-
Visa Application: The applicant submits Form DS-260, Immigrant Visa and Alien Registration Application, or adjusts status within the U.S. using Form I-485.
-
Interview and Medical Examination: The applicant will attend an interview at a U.S. consulate or USCIS office and undergo a medical examination.
-
Final Decision: If approved, the applicant receives their green card and becomes a lawful permanent resident.
